Halloween is nearly here, and many people are gearing up to enjoy the festivities. Because the holiday falls on a Saturday this year, parties are sure to extend late into the night. Before you suck back too many of those Jell-O shooters, remember that the Po Po will be out and about on Halloween night in search of impaired drivers.

If you plan enjoying a few drinks with your friends, remember to do so responsibly. Find an alternate ride home. Not only will you be safer for it, but you will also eliminate your risk of being charged with a DUI / OVI. However, if you do find yourself in a spooky legal situation, would you know what to do? What happens if you get arrested for DUI and are asked to take a blood test?

The answer: don’t let government vampires stick their fangs into you!

Why Blood Tests are a Bad Idea

When the government administers a blood test, they need to ensure that they place a certain amount of anticoagulant and preservatives in the sample to make sure that any contamination does not encourage fermentation. It is easy to mishandle samples by adding the wrong amounts of these substances to the blood, and as a result, alcohol can form within the sample and skew the results. Do you know what else can skew results? The nurse may even swab you with alcoholbefore drawing your blood!

Other potential issues can arise as well, including:

  • Chain of custody errors
  • Improperly sealed or leaky vials
  • Improper pipetting and sample agitation
  • Lack of refrigeration
  • Improper sterilization of equipment
  • Improper calibration, maintenance, or repair of equipment

With so many things that can (and often do) go wrong with a blood test, the best course of action is to choose to refuse! Don’t give the government the evidence they need to try secure a conviction. Instead, assert your right to a lawyer and call The Law Offices of Steven R. Adams, LLC.
