Steve Adams talked to Eddie and Tracy this past Friday (from the Eddie and Tracy radio show on WLW) about the new breath test machine, the Intoxilyzer 8000. When the Ohio Department of Health approved the Intoxilyzer 8000, they began limiting the information they are supposed to make available online to defense attorneys. Why? Because defense attorneys used to be able to have access to this data and have experts look at error codes, breath volumes, breath pressures, etc. to prove that the breath tests do not operate properly. Also, Steve notes that the Ohio Department of Health can tweak the information which is tantamount to tampering with evidence. CMI, the company that owns the Intoxilyzer 8000 is also able to remotely tweak the machine, which means they can tamper with the data.
Bottom line… NEVER blow, especially with this new device since it is so unreliable.
