Burglary SentencingIf you are convicted of burglary depending on the elements of the crime will depend on the sentence you may receive.

For example if the elements include:

  • By stealth, force, or deception
  • Trespass 
  • In an occupied structure, or 
  • In a separately secured or separately occupied portion of an occupied structure
  • When another person (other than the accomplice) is present or likely to be present
  • With the purpose to commit any criminal offense
  • In the structure or in a separately secured or occupied portion of the structure

If you are convicted with burglary contain the above elements, you could be facing a 2nd degree felony with 2-8 years in prison and a fine of up to $15,000.00. 

Or if the elements include:

  • By force, stealth, or deception
  • Trespass 
  • In an occupied structure, or 
  • In a separately secured or separately occupied portion of an occupied structure
  • With purpose to commit any criminal offense
  • In the structure or in a separately secured or occupied portion of the structure

A burglary conviction of the above is a 3rd degree felony with 9 – 36 months in prison and a fine of up to $10,000. For multiple robberies or burglaries, a prison sentence may be 1 – 5 years in prison.
