If you are asked to take a urine test on suspicion of DUI, choose to refuse the Pee Pee Po Po!
Why? Urine tests are the least reliable chemical test for determining DUI. When you drink, urine collects in your bladder until it is released. How is this a problem for urine tests? The results of urine tests are not an accurate representation of how much alcohol you had in your system at the time of driving. Even if you had a few drinks several hours ago and have not yet urinated, you can still test over the legal alcohol limit even if your BAC is within legal limits.
BAC AND URINE ALCOHOL CONCENTRATION ARE NOT THE SAME!
Many experts also agree that the concentration of drugs present in urine does not have any sort of reliable correlation to levels of alcohol in the blood. In fact, the alcohol concentration present in urine could be several times higher than the amount present in blood.
URINE TESTING MACHINES CANNOT BE TRUSTED WITHOUT MAINTENANCE
Another reason why urine testing is considered so unreliable is because the machines that do the testing often do not receive regular service and maintenance. This is likely to result in skewed results. DUI attorneys know this, the Po Po knows this, and the government knows this, so firmly (yet politely) decline a urine test if asked.
Additionally, if a sample cup is not be properly sealed, refrigerated, or sterilized, this may lead to bacterial growth and fermentation (yes, fermentation, as in ALCOHOL-CREATING) that could compromise results. For these reasons, this method of testing is disfavored in most states and is only administered as a last resort.
THE NATIONAL SAFETY COUNCIL AGREES – URINE TESTS NOT EFFECTIVE FOR JUDGING BAC
The National Safety Council has agreed that the analysis of urine to predict or obtain evidence of blood alcohol concentration is to be “discouraged.” If a government agency has admitted to this fact, then it is in your best interests to avoid a urine test, especially knowing that you will not be able to receive a second, independent test to help corroborate the results of the first.
