Penalties for Sexual Assault in Kentucky

Not all rape cases involve violent acts or force against a victim. Under Kentucky law, a person can be charged with rape if they engaged in non-consensual sexual activity with another person—in other words, the defendant did not have, or could not legally obtain, the other person’s consent.

There are three legal degrees to rape

  • Third Degree. If you engaged on sexual activity with an individual who is less than 18 years old (statutory rape), who was unable to consent due to lack of mental ability (including unconsciousness), or used your position of authority to engage in sexual activity, you may be charged with third-degree sexual assault. This is a Class D felony, and is punishable by up to 5 years in prison.
  • Second Degree. Any sexual activity with a person who is less than 14 years old or is unable to consent due to lack of mental ability is a Class C felony, punishable by up to 10 years in prison.
  • First Degree. Sexual activity with someone who is being forced against their will or who is physically vulnerable is a Class B Felony, punishable by up to 20 years in prison. If the victim was less than 12 years old, or if the victim sustained a serious physical injury in the attack, the charge is automatically categorized as a Class A felony and carries a sentence of 20 or more years in prison if convicted.
