Warren County Ohio OVI/DUI AttorneyAfter receiving a DUI in Ohio, you may lose your driver’s license and driving privileges. You may be able to regain limited driving privileges during your suspension with the help of a DUI attorney. Once your suspension period is over, you are eligible to reinstate your license - but it will not be reinstated automatically.

When you’re pulled over for a DUI, you could lose your license immediately. This is an administrative license suspension (ALS).

If you’re convicted of a DUI, your sentence will most likely include a Court ordered license suspension. The length of your suspension depends on multiple factors such as number of prior OVI convictions, breath/blood/urine test results, refusal and other factors.

How Can You Get Driving Privileges After a DUI in Ohio?

During your suspension, you may be able to get limited driving privileges with the help of an
attorney:
Challenge the suspension within 30 days of arraignment.
Request limited driving privileges after the first 15 days of suspension if you are a
first-time offender, or 30 days if you are a first-time offender who refused sobriety testing.
Request a stay of suspension, which would allow you to drive while your case is
pending. However, this decision is up to the judge’s discretion.
File for restricted driving privileges. The court may reinstate your license for specific work, education, or medical circumstances or to attend drug/alcohol treatment. The court may specify purposes, times, places, and other conditions.

After serving your suspension, you can reinstate your driver’s license. The steps to reinstate your license may vary based on whether you took a sobriety test, number of prior DUI convictions, and other factors. An experienced DUI lawyer can help guide you through this process and possibly challenge the length/terms of your suspension.

Once your suspension period is up the following steps maybe required to reinstate your driver’s license and get back on the road.

● Submit a reinstatement form (Alcohol/Drug Reinstatement form BMV 2326) to the Ohio BMV.

Pay a reinstatement fee of $475 to the Ohio BMV.

Provide proof of insurance. If you have a DUI conviction, you are required to have an SR-22 in addition to your insurance. An SR-22 is a certificate for those who are considered “high-risk drivers.

Complete any other requirements i.e. paying fines, serving jail time, driving courses, etc. If you are a first time offender, the court may allow you to complete the Ohio’s Driver Intervention Program (DIP) as an alternative to the mandatory three-day jail term.
